Business Group Urges Congress to Protect ERISA Preemption from Damaging Carve-out Proposals

Business Group on Health, as part of the National Coalition on Benefits, urged Congressional leaders to preserve ERISA preemption from efforts to erode its protections and preserve uniform benefits for self-insured health and welfare plans.

Business Group on Health, in collaboration with the National Coalition on Benefits (NCB) and other allies, sent a letter to Congressional leadership urging for continued protection of preemption provisions under the Employee Retirement Income and Security Act of 1974 (ERISA). The Business Group and other signatories expressed strong opposition to efforts that would directly or indirectly limit ERISA preemption in pharmacy benefit manager (PBM)-related legislation currently under consideration by Congress, emphasizing the important foundation that ERISA preemption provides employers to design and uniformly administer their self-insured health and welfare plans nationwide.
